RUBINOWILSON TERMS AND CONDITION OF SUPPLY

This page provides information about RubinoWilson and the terms and conditions of which we sell any of our services listed on the website www.rubinowilson.com.

These terms apply to any contract between us for the sale of products to a customer or client. Please read these terms carefully and make sure that you understand them, before ordering any products from RubinoWilson. Please note that when placing an order, the customer or client is confirming that they agree to these terms. If the customer refuses to accept these terms, they will not be eligible to order any products or services from RubinoWilson. These terms were most recently updated on 01/05/2024. These terms, and any contract between us, are only available in the English language.

1. INFORMATION ABOUT US
​
1.1. We operate the website www.rubinowilson.com. We are RubinoWilson, a partnership registered with The UK Government. Our registered address is: Unit 5, Barn 5, Grandeys Heritage Craft Centre, Green Tye, Hertfordshire SG106FF.

2. HANDMADE PRODUCTS DISCLAIMER
​
2.1. The images of the products on our site are for illustrative purposes only. Although we have made every effort to display the colours accurately, we cannot guarantee that the customer’s computer display of the colours accurately reflect the colour of the products. Customers products may vary slightly from our images.
2.2. Although we have made every effort to be as accurate as possible, because our products are handmade, all sizes, weights, capacities, dimensions and measurements can have a 5% tolerance.
2.3: Due to the nature of handmade products, small imperfections are always possible on the item. This is a result of the piece being made by hand.

3. OUR RIGHT TO VARY THESE TERMS

3.1. We amend these terms annually.
3.2. Every time a product order is placed, the terms in force at the time of the order will apply to the contract between the customer and us. We may revise these terms as they apply to the order to reflect the following circumstances:

  1. (a)  Changes in relevant laws and regulatory requirements; or

  2. (b)  Circumstances relevant to us.

4. ONLINE FORM SUBMISSIONS:
​
4.1. Contacting RubinoWilson via our online form submission system will allow us to contact the customer or client regarding the enquiry. We will contact the customer or client by email or telephone within 24 hours of the form being submitted.
4.2. By submitting a form or contacting us the customer is agreeing that RubinoWilson can make contact.
 
5. HOW TO ORDER
5.1. All RubinoWilson products or services are available to order through this website. Once an enquiry is received the customer will be contacted by RubinoWilson.
5.2. The customer can pay for products using a debit card or credit card using a payment link or BACS.
 
6. RUBINO WILSON FURNITURE PRODUCTS AND DELIVERY CHARGES

6.1. These are in the RubinoWilson product range under the shop on the website. Prices are available upon request and may change, but changes will not affect any order a customer has already placed. Payment in full is required for all products.
6.2 RubinoWilson products which are personalised with a specific finish, colour or material are bespoke; remedies are available but not refunds or replacements in line with the Consumer Rights Act.
6.3. The price of a product does not include delivery charges. RubinoWilson delivery charges are based on a case-by-case basis.
 
7. BESPOKE SERVICE FOR RESIDENTIAL PROJECTS:

7.1. Bespoke projects are made once or in small productions.
7.2 RubinoWilson will consult with the client on the design and construction elements of the project and advise where possible to achieve the best outcome.
7.3 For bespoke fabrication service payment, 50% deposit for all orders is required in advance. The deposit is non-refundable. Where discounts are applied, payment in full is required. Payments on final balances are expected without undue delay, and subsequently signal the end of the contract.
7.4. Payment for bespoke service items is non-refundable, but remedies can be discussed in line with the Consumer Rights Act.
7.5 RubinoWilson reserves the right to charge for additional revisions to the project. The revisions charge is set at £150.00 per revision. This charge is to reflect the additional time required to create CAD drawings, source quotes for the project and administration. The revisions charge will be added to the jobs invoice and payment is due in line with the payment terms, it will be billed as a revision fee.
7.6 If the client cancels the job and the design has been revised the client is still liable for any revision charges and will be invoiced by RubinoWilson.
 
8. PROVIDING RUBINOWILSON UK LTD WITH A BESPOKE DESIGN OR PRODUCT FOR MANUFACTURE.

8.1 Providing a bespoke design or product for manufacture is defined as the client being solely responsible for the design direction of the piece. This includes metal fabrication work.
8.2 Due to the explorative nature of working with client’s concept designs and/or drawings these projects do not qualify for a free design consultation. Explorative work includes all-time required to complete the administration for the project (meetings, telephone calls, emails and site visits etc); this is billed at an hourly rate recorded by RubinoWilson.
8.3. By providing a design the client is sub-contracting RubinoWilson to manufacture the piece and therefore RubinoWilson cannot be held responsible for any unforeseen problems with the design. Any additional charges will be added to the projects invoice to rectify the unforeseen problems or time taken to investigate the bespoke piece if the correct information is not provided.
8.4 Bespoke manufacturing by its nature can present unforeseen problems in the manufacturing process. RubinoWilson reserves the right for a degree of interpretation when manufacturing products to make sure the piece is delivered to the best possible standard.
8.5 When the client is responsible for providing technical (CAD) drawings. It is the client’s responsibility to check the accuracy of these drawings and provide clear instructions on the components and assembly of the product. This includes specifications, fixtures and fittings within the piece.  
 
9. DELIVERY

9,1. RubinoWilson does deliver to addresses outside the UK; a project specific quote will need to be generated.
9.2. When delivery has been arranged by the client, the client is responsible for making sure that the bespoke items can be safely delivered. We advise you to check all halls, doorways and rooms to make sure the bespoke item can be delivered.
 
10. INTELLECTUAL PROPERTY AND COPYRIGHT
10.1 RubinoWilson owns all intellectual property and copyright to the work produced. RubinoWilson designs are registered with the Intellectual Property Office (IPO) and governed by copyright law.
10.2 If the client supplies their own design for RubinoWilson to produce, the client will be solely liable for any copyright infringement.
 
11. CONTRACT FURNITURE WARRANTY
 
11.1 Warranty for contract furniture purchases only applies to the original purchaser of the products.
11.2 The warranty covers the products for reasonable use within commercial settings.
11.3 The warranty means the furniture is free from defects in materials and construction for 24 months from the date of delivery. If a defect is found, RubinoWilson will either repair or replace the defective item, at our discretion.
11.4 RubinoWilson subcontracts the upholstery of products to a supplier and therefore will work with them to resolve any defective items. Fabrics are subject to specific warranty and guidelines of use.
11.5 RubinoWilson will supply all necessary datasheets for the fabrics and filling to demonstrate meeting relevant regulations.
11.6 Some aspects of use are out of the manufacturers control and therefore the following is not covered by the warranty;

  • Any condition resulting from incorrect or inadequate maintenance, cleaning or care, or commercial use.

  • Any condition resulting from other than ordinary wear and tear or from any use for which the product was not designed.

  • The matching of colour, grain, or texture of wood, leather or fabrics.

  • The colourfastness, dye lot variations, wrinkling, or wear of fabrics or leather.

  • The softening of filling materials under normal use.

  • Defects that result from negligence, misuse, or accidents. 

 
12. EVENTS OUTSIDE OF OUR CONTROL

12.1 We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a contract that is caused by an event outside our control, defined below;
12.2. An event outside our control means any act or event beyond our reasonable control, including: workshop closure, without limitation strikes, lock-outs or other industrial action by third parties, civil commotion, epidemic, pandemic, or other natural disaster, impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.
13. Consumers have the right to readdress for RubinoWilson goods and services but must do so in writing without undue delay after taking ownership of the goods and services.
13.2 The customer has no right to cancel when buying bespoke goods and/or services that are made to customer specification or are personalised. If the customer wishes to cancel and withdraw, this must be done so in writing and is subject to relevant deductions on non-refundable material goods and labour.
 
14. QUOTED & ESTIMATES IN INFLATIONARY TIMES:

14.1 Due to uncertainty and increasing costs of materials post-Brexit, the estimate or invoice may not represent the final price of the work completed. This is due to the changes our suppliers may make between providing an estimate and ordering materials.
14.2: Adjustments to the final invoice will be made after discussion with the client, but the increasing difficulty to operate a fixed price model for bespoke goods must be acknowledged by the customer.
